1) Approval of Agenda June 21, 2005-06-20

Council agenda of June 21, 2005 as presented.

Government Affairs
3) Out of State Travel Request for Tracie Stevens
Motion made by Les Parks to approve the out of state travel
for Tracie Stevens and any Village Council member to attend NIGA 2005
Legislative Summit in Washington D.C., July 11-14, 2005 at a cost of
$1,782.21 each to come Government Affairs budget.

4) Out of State Travel Request for John McCoy
Discussion: Glen Gobin, Les Parks, John McCoy
The Dellum Commission works with communities with issues such as why
juveniles are tried as adults. The commission works with Tribal
Correction Facilities and provides information on planning. There are
currently (2) Native Americans on the commission. The commission works
in conjunction with (8) other local tribes. Chief Goss is also
involved. The commission is for people of color. The Dellum Commission
will reimburse the tribe for travel expenses
Motion made by Glen Gobin to approve the out of state
travel request for John McCoy to attend the Dellum Commission
Conference in Washington, D.C., July 24-28, 2005 with the tribal
expense to be refunded by the Dellum Commission

facility could be built with other funds in conjunction with local
tribes.

5) Out of State Travel Request for Nina Reece
Motion made by Glen Gobin to approve the out of state travel for Nina Reece
and any Village Council member to attend the National Intertribal Tax Alliance
Conference in Cabazon, CA, September 21-23, 2005at a cost of $1,519.11 each to come from
the Quil Ceda Village Administrative travel budget.

Questions: Will the BOD travel come from the BOD budget, or Village budget? Staff will
need to check the availability of the travel budget for the Quil Ceda Village. A Tribal
Attorney will attend.
6) Draft Reading of Restaurant Privilege Tax
Discussion: Mike Taylor, Peter Mills, John McCoy, Glen Gobin, Chuck James, Les Parks,
Steve Gobin
The tax is a Restaurant Privilege tax. The state is currently collecting sales tax from
Village businesses. Even the Indian owned businesses are paying taxes to the State that
they should not be paying. Council wants to know where the taxes should be paid. Quil
Ceda Village should be receiving the tax. Staff is recommending that all Indian owned
restaurants within the Village should be taxed. The tax needs the Village Council’s
approval. The state tax on restaurant sales is 8.5% for this area. Recommendations are
that the tax structure should not be limited to just Indian owned businesses within the
Village. They should apply to all businesses within the Village. Why are the taxes
imposed on seller? It is the seller’s responsibility to collect the tax from the user
and remit it to the Village. Will the prices go up on liquor sales? Yes. The tax
applies to prepared food and drinks. How does this apply to comps? If the seller keeps
tracks of comps, will we have to pay the taxes on comps such as soft drinks and food?
It will apply as it states in the current draft. Council can make the decision to
remove the comps from taxation. Council would like to remove the comps from taxation.
What is the timing for imposing this tax? It could begin as early as one month? Will
this apply to Arby’s and QC Creek Casino? No, the Village does not have the authority
to go outside of its boundaries to tax. The Tulalip Board of Directors will need to
create a similar Ordinance for those businesses with the Reservation but outside of Quil
Ceda Village. The process needs to go forward. Staff is to go forward with a public
meeting. Council would like to get this started as soon as possible. Council thanks
staff for drafting this amendment to the Village Tax Code.

8) Governor’s Trip to China
A) FYI-Discussion: John McCoy
Tulalip has been officially invited to send a delegate to assist the Governor of the
State of Washington on her trip to China. The trip is scheduled for September 17-27,
2005 at an estimated cost of $6,000 each. This has been brought to Village Council so
a tentative appointee will be considered. The agenda is very heavy with 16 hours work
days. There will be no time for sightseeing or other activities. Have any other
tribes been invited? This is unknown.

11) Update Out of State Travel Request for Tom Gobin & Lukas Reyes
Motion made by Les Parks to approve the changes for out of state travel
request for Tom Gobin and Lukas Reyes to Pala Casino & Resort in San Diego, CA June
23-25, 2005, at a new cost of $1,249.05 each to come from the Utilities travel
budget.
