Fireworks Prohibited Within Boundaries

WHEREAS, the Village Council is the governing body of the Consolidated Borough of Quil Ceda Village under the Village Charter approved by the Tulalip Tribes' Board of Directors pursuant to Ordinance 111, and
 
WHEREAS, the Village Council is empowered by Article I, Section 3 and Article VII, Sec. 2(b) of the Charter to exercise governmental powers to protect public safety, health and welfare of all persons within the Village, and
 
WHEREAS, the Council finds that the discharge or ignition of fireworks within the boundaries of the Village presents a public safety concern and is inconsistent with the current and future development plans of the Village,
 
NOW THEREFORE, BE IT ORDAINED by the Council of the Consolidated Borough of Quil Ceda Village as follows:
 
Court Given Jurisdiction
The Tribal Courts of the Tulalip Tribes are hereby provided jurisdiction to hear and determine all causes brought under the Ordinances of the Consolidated Borough of Quil Ceda Village
 
Enforcement
All commissioned law enforcement officers of the Tulalip Tribes are hereby granted authority to enforce the Ordinances of the Consolidated Borough of Quil Ceda Village.
 
Fireworks Prohibited
The discharge or ignition of fireworks within the boundaries of the Quil Ceda Village is prohibited. Any person found to have violated this prohibition shall be subject to a civil penalty not to exceed $100.00, and in addition, shall be subject to having all fireworks in their possession confiscated and forfeited and shall be given an immediate eviction under escort from the Village boundaries. For purposes of this provision, "fireworks" shall have the same meaning as it has in Tulalip Tribal Ordinance 52, and the due process procedural provisions of Tulalip Tribal Ordinance 114 shall apply to any penalties levied.
