WHEREAS, the Village Council is the governing body of the Consolidated Borough of Quil Ceda Village under the Village Charter approved by the Tulalip Tribes' Board of Directors pursuant to Ordinance 111, and
 
WHEREAS, the Village Council is empowered by Article I, Section 3 and Article II, Section I, and Article III, Section 3, and Section 3(a) of the Charter to exercise governmental powers, and
 
WHEREAS, the Council adopted Resolution No. 20-0002, Quil Ceda Village Human Resource Ordinance 84, with amendments.
 
NOW THEREFORE BE ENACTED that the Council of the Consolidated Borough of Quil Ceda Village grants a variance to Ordinance 84 which shall read as follows:
 
  The management of the Consolidated Borough of Quil Ceda Village after advertisement, application, and certification of applicants in a hiring process under Ordinance 84 may hire an applicant without reference of the applicant or applicants to the Selection Committee and without evaluation as defined in Tulalip Ordinance 84, V.H. and V.I. when:
 
a. Only one Tulalip Tribal member is a bona fide applicant for the advertised position.
b. The single Tulalip Tribal member applicant is fully qualified for the advertised position consistent with the requirements for the position set out in the job announcement for the position.
 
ADOPTED by the Village Council at a regular meeting assembled on the 6th of August, 2002, with a quorum present, by a vote of 2 for and 0 against.
